These terms govern your use of Atend, a time-tracking service provided by ClarityBuilds Ltd ("we", "us"). By creating an account you agree to them.
1. The service
Atend automatically reconstructs your working time from device metadata, classifies it, and helps you produce billable timesheets. Features, limits, and plans are described on our pricing page and may evolve.
2. Accounts
You must provide accurate information, keep your credentials secure, and be responsible for activity under your account. You must be of legal age and able to enter a contract. Workspace owners are responsible for the members they invite.
3. Subscriptions, billing & taxes
Paid plans are sold and invoiced directly by ClarityBuilds Ltd. Invoices are payable by bank transfer within the period stated on the invoice (14 days unless agreed otherwise). For VAT-registered business customers in other EU member states, the reverse-charge mechanism applies (invoiced net; you account for VAT); customers in Malta are charged Maltese VAT. Subscriptions renew for successive periods until cancelled; you can cancel anytime, effective at the end of the current paid period. If an invoice is not paid by its due date we may suspend access until it is settled.
4. Acceptable use
You agree not to misuse the service: no unlawful use, reverse engineering, security circumvention, reselling without permission, or use to surveil people without their knowledge contrary to applicable law.
5. Your data & ownership
You own your data. We process it to provide the service per ourPrivacy Policy. We own the Atend software, brand, and underlying IP. You can export your data and delete your account at any time.
6. Warranties & liability
The service is provided "as is" without warranties to the extent permitted by law. Atend assists with timekeeping but you are responsible for reviewing and approving time before you bill it; we are not liable for billing decisions you make. To the maximum extent permitted by law, our aggregate liability is limited to the fees you paid in the 12 months preceding the claim. Nothing limits liability that cannot be excluded by law.
7. Termination
You may stop using the service and delete your account anytime. We may suspend or terminate accounts that breach these terms. On termination you can export your data for 30 days, after which it is deleted per the Privacy Policy.
8. Governing law
These terms are governed by the laws of Malta, and disputes are subject to the courts of Malta, without prejudice to mandatory consumer-protection rights you may have where you live.
